Welcome to ToonMark!

These Terms of Service ("Terms") constitute a legally binding agreement between you and the ToonMark operations team regarding your access to and use of the ToonMark mobile application and related services. Please read these Terms carefully before using our software. By downloading, installing, or using ToonMark, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Description of Services

ToonMark is an application designed for comic book lovers, offering aggregated manga reading, smart genre filtering, local bookshelf organization, reading history tracking, and the unique Moments Canvas editing and sharing workspace. We strive to provide a clean, distraction-free reading experience, allowing you to curate digital panels and capture your reading inspiration.

2. User Guidelines and Copyright Protection

ToonMark highly respects the intellectual property rights of comic creators and artists. We provide the Moments Canvas tool to enable users to crop and annotate manga pages for personal study, appreciation, or non-commercial logging and sharing. By using the Moments Canvas and sharing features, you agree to comply with the following rules:

• Respect for Copyright: Images cropped, annotated, and shared using the Moments Canvas must strictly remain within the scope of personal entertainment, study, fair use, and non-commercial communication. You must not use the application for large-scale duplication, commercial redistribution, or any actions that infringe on the original authors' copyrights.
• Appropriate Annotations: When using the doodle, text, or styling tools inside the Moments Canvas and sharing the resulting cards to external social media networks, you must ensure that all added comments, notes, and modifications are legal, respectful, and free of violent, pornographic, politically sensitive, defamatory, or privacy-violating content.
• Personal Responsibility: You are solely responsible for any legal issues or disputes arising from your personal edits, annotations, or the subsequent sharing of your custom Moments cards to third-party platforms.

3. Intellectual Property Rights

The ToonMark software, including all user interface designs, interaction models, brand graphics, logos, and the code underlying the Moments Canvas, is the exclusive intellectual property of the ToonMark team. All comic works and associated graphics displayed within the application are the property of their respective creators, publishers, or authorized licensors. No user is permitted to use the manga content for commercial monetization without obtaining prior written consent from the copyright owners.

4. Disclaimers

To the maximum extent permitted by applicable law, we disclaim liability for the following scenarios:

1. Provided "As-Is": This software and related services are provided on an "as-is" and "as-available" basis. We make no guarantees that the services will be uninterrupted, timely, secure, or completely error-free.
2. Third-Party Links and API Failures: The application may rely on third-party APIs or include links to external sites. We are not liable for loading failures, content unavailability, or service interruptions caused by third-party API adjustments, network failures, or other force majeure events.
3. Device Compatibility: We are not legally responsible for operational failures, crashes, or incompatibilities caused by your mobile device hardware, operating system configurations, or network environments, though we will actively assist in troubleshooting.

5. Dispute Resolution and Governing Law

These Terms, their construction, validity, performance, and any disputes arising out of them shall be governed by and construed in accordance with the laws of the jurisdiction where the ToonMark team operates (excluding conflict of law principles). Any disputes that cannot be settled amicably shall be submitted to the court of competent jurisdiction in the operations team's location.

6. Amendments to Terms

We reserve the right to amend these Terms at any time. The updated version will become effective immediately upon being published in the application. If you do not agree to the revised Terms, please cease using ToonMark immediately. Your continued use of the application constitutes acceptance of the amended Terms.
